B\u00fcy\u00fck yerle\u015fmeler risk havuzlar\u0131na d\u00f6nm\u00fc\u015f durumdad\u0131r. Peki, nas\u0131l bir strateji izlemeli? <\/em><\/p>\n<p>\u00dclkemizde deprem dahil afet risklerinin istenilen d\u00fczeyde azalt\u0131lamamas\u0131n\u0131n temel nedenleri ileriye d\u00f6n\u00fck ve \u00f6d\u00fcns\u00fcz uygulanan bir \u201cUlusal Afet Stratejisi\u201d olu\u015fturamamam\u0131z ve plans\u0131zl\u0131k ve denetimsizlik y\u00fcz\u00fcnden olu\u015fan \u201cAfet G\u00fcvensiz Yerle\u015fimler\u201ddir. Anadolu\u2019ya geldi\u011fimiz y\u00fczy\u0131ldan bu yana h\u00e2l\u00e2 bir yerden bir yere g\u00f6\u00e7 edip duruyoruz ve \u201cafet g\u00fcvenli yerle\u015fim\u201d i\u015fini \u00e7\u00f6zemiyoruz. \u201cPlanlamac\u0131\u201d de\u011fil de \u201ckapmac\u0131\u201d ve \u201crant\u00e7\u0131\u201d bir zihniyetle olu\u015fan yerle\u015fmelerde yaln\u0131z deprem de\u011fil, sel, heyelan vb. k\u00f6kenli kay\u0131plar\u0131m\u0131z\u0131n miktar\u0131 h\u0131zla art\u0131yor. Plans\u0131z kentle\u015fmenin sonucu olarak T\u00fcrkiye art\u0131k n\u00fcfus ve yat\u0131r\u0131m yo\u011funluklar\u0131n\u0131n deprem riski alt\u0131nda oldu\u011fu bir \u201ckent depremleri\u201d s\u00fcrecine girmi\u015f bulunuyor. B\u00fcy\u00fck yerle\u015fmeler risk havuzlar\u0131na d\u00f6nm\u00fc\u015f durumdad\u0131r. (1) Birinci ve ikinci derece deprem b\u00f6lgelerinde say\u0131s\u0131 h\u0131zla artan ticari ve end\u00fcstriyel yat\u0131mlar ve onun tetikledi\u011fi n\u00fcfus art\u0131\u015f\u0131, afet risklerini b\u00fcy\u00fct\u00fcyor. \u0130hracat potansiyeli milyar dolarlara yakla\u015fan illerimizin b\u00fcy\u00fck bir b\u00f6l\u00fcm\u00fc birinci derece deprem b\u00f6lgelerindedir. \u0130stanbul dahil bir\u00e7ok kentimizde deprem tehlikesi de\u011fi\u015fmese bile plans\u0131z ve denetimsiz yerle\u015fmeler ve yat\u0131r\u0131mlar nedeniyle afet k\u00f6kenli kay\u0131p riski \u00fcstel bir h\u0131zla artmaktad\u0131r. 1999 depreminden sonra bir\u00e7ok yasa ve y\u00f6netmelikler \u00e7\u0131kmas\u0131na kar\u015f\u0131n, istatistikler son y\u00fczy\u0131lda deprem zararlar\u0131n\u0131 azaltmada istenilen d\u00fczeyde ba\u015far\u0131l\u0131 olamad\u0131\u011f\u0131m\u0131z\u0131 g\u00f6stermektedir. 1992 Erzincan, 1995 Dinar, 1998 Adana-Ceyhan ve en son 1999 Kocaeli-D\u00fczce depremleri bu s\u00fcrecin ac\u0131 \u00f6rnekleridir. Ekonomik g\u00fcc\u00fcn\u00fc y\u00fckseltmeyi hedefleyen bir \u00fclke, depremi en az kay\u0131pla atlatma yolunda da ba\u015far\u0131l\u0131 olmak zorundad\u0131r.<\/p>\n<p><strong>Yap\u0131lmas\u0131 gereken yasal d\u00fczenlemeler<br \/>\n<\/strong>\u00dclkemizin deprem risklerini azaltma politikalar\u0131nda al\u0131nmas\u0131 gerekli tutumun en g\u00fcncel bir \u00f6zeti 2002 y\u0131l\u0131nda Ulusal Deprem Konseyi (2) taraf\u0131ndan haz\u0131rlanan \u201cDeprem Zararlar\u0131n\u0131 Azaltma Ulusal Stratejisi\u201d belgesinde bulunmaktad\u0131r. Buradan k\u0131saca al\u0131nt\u0131 yap\u0131lacak olursa, geni\u015f \u00f6l\u00e7ekte yasal d\u00fczenlemelere gereksinim vard\u0131r. Bunlar\u0131 \u015fu genel ba\u015fl\u0131klar alt\u0131nda toplayabiliriz:<br \/>\n1.a) Deprem afetinin yol a\u00e7t\u0131\u011f\u0131 kay\u0131plar\u0131n azalt\u0131lmas\u0131nda \u201cyara sarma\u201d politikas\u0131 yerine \u201c\u00f6nceden al\u0131nan \u00f6nlemlerle giderme\u201d politikalar\u0131 benimsenmelidir.<\/p>\n<ol>\n<li>b) 1999 depremleri sonras\u0131nda benimsenen (fakat sonradan yava\u015flayan) genel risk azaltma politikas\u0131 anayasa dahil di\u011fer yasal mevzuata ge\u00e7irilmelidir.<\/li>\n<li>c) Deprem ve afetler konusundaki kurumsal yap\u0131lanma siyasetin \u00fczerinde olmal\u0131d\u0131r.<\/li>\n<li>d) Yeni kurumlar yaratmak yerine mevcutlar\u0131n birbirlerini tamamlar ve uyum i\u00e7inde i\u015fler duruma getirilmesi hedeflenmelidir.<\/li>\n<li>e) Afetler Yasas\u0131 ve buna ait y\u00f6netmelikler, \u0130mar Yasas\u0131 ve buna ili\u015fkin mevzuat ile Strateji Raporunda say\u0131lan di\u011fer mevzuat ili\u015fkilendirilmelidir.<\/li>\n<li>f) Yap\u0131 denetimi ve buna ili\u015fkin mevzuat, vatanda\u015f\u0131 afet sonras\u0131nda \u00e7aresizlik i\u00e7inde b\u0131rakmayacak tarzda ele al\u0131nmal\u0131, 4708 say\u0131l\u0131 Yap\u0131 Denetimi Kanunu daha etkili h\u00fck\u00fcmlerle g\u00fc\u00e7lendirilmelidir.<\/li>\n<li>g) Do\u011fal Afet Sigortalar\u0131 Kurumu (DASK) Kanunu, yeni d\u00fczenlemeler yap\u0131larak bir an \u00f6nce ya\u015fama ge\u00e7irilmelidir.<\/li>\n<li>h) Teknik i\u015f g\u00fcc\u00fcn\u00fcn yetkinli\u011fi mevzuat d\u00fczenlemeleriyle sa\u011flanmal\u0131d\u0131r.<\/li>\n<li>i) Belediye ve mahalli idarelerin yap\u0131la\u015fma ile ilgili hizmetlerinde d\u00fczeltmelere gidilmelidir.<\/li>\n<li>j) Kamu hizmet binalar\u0131n\u0131n projelerinin yeni bir anlay\u0131\u015fla g\u00f6zden ge\u00e7irilmesi sa\u011flanmal\u0131d\u0131r.<\/li>\n<\/ol>\n<p>T\u00fcrkiye 1940\u2019larda \u201cdeprem y\u00f6netmelikleri yapma\u201d bilincinde olan bir \u00fclke olmas\u0131na kar\u015f\u0131n g\u00fcn\u00fcm\u00fczde ne yaz\u0131k ki 4-5 b\u00fcy\u00fckl\u00fc\u011f\u00fcndeki depremlerde dahi beklenmedik kay\u0131plarla kar\u015f\u0131la\u015fmaktay\u0131z. Bunun nedenleri, \u00f6n\u00fcm\u00fczdeki \u015fu kadar y\u0131lda \u015fu b\u00fcy\u00fckl\u00fckte deprem olabilece\u011fini tahmin edemememiz, onlarca televizyon kanal\u0131na, internete, radyoya ra\u011fmen insanlar\u0131m\u0131z\u0131n bunu bilmemesi veya bilim insanlar\u0131m\u0131z olmamas\u0131 de\u011fil, \u201cafet g\u00fcvenli yerle\u015fim\u201d kavram\u0131n\u0131n hi\u00e7bir d\u00fczeyde yerle\u015fememesi ve yapt\u0131r\u0131mlar\u0131n suland\u0131r\u0131lmas\u0131d\u0131r. Mevcut afet, imar, denetim ve zorunlu sigorta ile ilgili yasa ve y\u00f6netmeliklerimizin eksikli\u011fi, ayr\u0131ca belediye y\u00f6netimlerimizin insan kaynaklar\u0131 yetersizli\u011fi ve siyasi zaafiyetleri nedeniyle uygulama ve yapt\u0131r\u0131m yetersizlikleri oldu\u011fu bilinmektedir. Ancak bu durum, fay\u0131n ve heyelan\u0131n \u00fcst\u00fcne, dere yata\u011f\u0131na, \u00e7amura bina yap\u0131n, depreme dayan\u0131ks\u0131z bina in\u015fa edin, demiri vas\u0131fs\u0131z \u00fcretin, projeyi yanl\u0131\u015f uygulay\u0131n anlam\u0131na gelmez. Eksiklikleri olsa bile, \u00fclkemiz i\u00e7in \u015fu anda bilinen deprem olu\u015fma olas\u0131l\u0131klar\u0131, kar\u015f\u0131la\u015f\u0131labilecek sars\u0131nt\u0131 \u015fiddetleri ve jeolojik \u00f6zellikler gibi bilgiler ciddiye al\u0131nd\u0131\u011f\u0131nda ve bunlara g\u00f6re deprem y\u00f6netmelikleri harfiyen uyguland\u0131\u011f\u0131nda deprem zararlar\u0131n\u0131n \u00f6nemli oranlarda azalt\u0131lmas\u0131 sa\u011flanabilir.<br \/>\n1999 depremlerinden sonra, bu \u00fclkede deprem zararlar\u0131n\u0131n azalt\u0131lmas\u0131 uygulamalar\u0131nda yeni yapt\u0131r\u0131mlar ve d\u00fczenlemeler getirece\u011fini umdu\u011fumuz niyetler ve kurumsalla\u015fma \u00e7abalar\u0131, beklenen olu\u015fumlar\u0131 bug\u00fcne kadar sa\u011flayamam\u0131\u015ft\u0131r.\u00a0 17 A\u011fustos 1999 depreminin yaratt\u0131\u011f\u0131 sonu\u00e7lar\u0131n da etkisiyle, Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131 28 Eyl\u00fcl -1 Ekim 2004 tarihinde 360 \u00fcye kat\u0131l\u0131m\u0131yla ba\u015far\u0131l\u0131 bir Deprem \u015euras\u0131 d\u00fczenlemi\u015f ve T\u00fcrkiye\u2019nin deprem ger\u00e7e\u011fine duyarl\u0131l\u0131\u011f\u0131n\u0131 ve ilgili sorunlar\u0131na \u00e7\u00f6z\u00fcm aray\u0131\u015f niyetini devlete ve topluma a\u00e7\u0131klam\u0131\u015ft\u0131r. (3) Ancak 34 maddelik \u015eura Kararlar\u0131 sonras\u0131 faaliyetlerin ve uygulamalar\u0131n h\u0131z\u0131 beklentilerimizin alt\u0131ndad\u0131r. Do\u011fald\u0131r ki, deprem ve di\u011fer afet risklerinin azalt\u0131lmas\u0131na katk\u0131 sa\u011flayacak yasa ve y\u00f6netmeliklerin birbirlerini desteklemesi ve uyumlu olmas\u0131 beklenir. Ancak, depremden sonra ge\u00e7en on y\u0131l sonunda, baz\u0131 yasalar\u0131n bug\u00fcne kadar \u00e7\u0131kmamas\u0131 nedeniyle bu uyumun sa\u011flanamad\u0131\u011f\u0131n\u0131 gerek\u00e7e g\u00f6stermek, durumu a\u00e7\u0131klamaya yeterli olamaz. Ba\u015fbakanl\u0131k Proje Uygulama Birimi\u2019nce 1997-1999 y\u0131llar\u0131nda yapt\u0131r\u0131lan \u201cAfet Zararlar\u0131n\u0131 Azaltmak Amac\u0131yla \u0130mar Sisteminin Revizyonu\u201d raporu \u00fczerinden on y\u0131l ge\u00e7mi\u015f bulunuyor. \u0130lgili meclis komisyonlar\u0131n\u0131n ar\u015fivlerinde bekleyen \u0130mar Yasas\u0131 Tasla\u011f\u0131 daha ne kadar bekleyecektir? Yeni \u0130mar Yasas\u0131\u2019nda imar aff\u0131 yasa\u011f\u0131, yap\u0131 denetim kavram\u0131, sak\u0131n\u0131m plan\u0131, kentsel d\u00f6n\u00fc\u015f\u00fcm ve mikrob\u00f6lgeleme kavramlar\u0131 mutlaka yerlerini almal\u0131d\u0131r.<\/p>\n<p><strong>\u201cZarar azaltma\u201d de\u011fil \u201crisk azaltma\u201d<br \/>\n<\/strong>Yasa ve y\u00f6netmeliklerde kullan\u0131lan s\u00f6zc\u00fck ve kavramlar\u0131n ger\u00e7ek anlamlar\u0131nda kullan\u0131lmas\u0131 \u00f6nemlidir. Afetlerle ilgili konularda T\u00fcrkiye\u2019de \u201czarar azaltma\u201d ve \u201crisk azaltma\u201d kavramlar\u0131 birbirine kar\u0131\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Terc\u00fcmelerden kaynaklanan kavram yan\u0131lsamalar\u0131, belirlenen politika ve stratejilerin anla\u015f\u0131lmas\u0131n\u0131 ve topluma anlat\u0131lmas\u0131n\u0131 zorla\u015ft\u0131rmaktad\u0131r. \u00d6rne\u011fin \u0130ngilizce \u201cmitigation\u201d kar\u015f\u0131l\u0131\u011f\u0131 \u201czarar azaltma\u201d olarak ifade edilmi\u015f, ancak bu s\u00f6zc\u00fc\u011f\u00fcn \u201crisk azaltma\u201d olarak anla\u015f\u0131lmas\u0131 gerekti\u011fi belirtilmi\u015ftir (Balamir, 2010). \u201cZarar\u201d zay\u0131fl\u0131klar oran\u0131nda ortaya \u00e7\u0131kan bir sonucu ve durumu g\u00f6stermektedir. Dolay\u0131s\u0131yla risk azaltma afet \u00f6ncesi ve sonras\u0131nda t\u00fcm \u00e7al\u0131\u015fmalar\u0131 i\u00e7eren bir sahad\u0131r. Bu t\u00fcr yanl\u0131\u015f kullan\u0131mlar \u0130l \u00d6zel Y\u00f6netimi Yasas\u0131na (5302) ve Belediyeler Yasas\u0131na (5393) s\u0131zm\u0131\u015f bulunmaktad\u0131r (4). \u201cDeprem afetinden korunma ve zararlar\u0131n\u0131 azaltma\u201d yerine \u201cdeprem tehlikesinden korunma ve risklerini azaltma\u201d c\u00fcmlesi daha do\u011frudur. Tehlikeden korunuruz, riski azalt\u0131r\u0131z. B\u00f6ylece afet olmaz veya \u00e7ok az etkisi olur. Benzer \u015fekilde \u201cafet plan\u0131\u201d yapmak yerine riskleri azaltacak \u201csak\u0131n\u0131m plan\u0131\u201d yapmak gerekiyor.<br \/>\n1999 depremleri sonras\u0131 afet \u00f6ncesi risk azaltma \u00f6nlemlerini devreye sokacak \u201cRisk Y\u00f6netimine\u201d a\u011f\u0131rl\u0131k veren, dolay\u0131s\u0131yla deprem an\u0131 ve sonras\u0131 \u201cM\u00fcdahale Sistemi\u201dnin i\u015fini hafifleten bir \u201cAfet Y\u00f6netim Sistemi\u201d kurulmas\u0131 gere\u011fi tart\u0131\u015f\u0131lmaya ba\u015flanm\u0131\u015ft\u0131r. (2) \u00dclke ve kent baz\u0131nda afet y\u00f6netiminde koordinasyon ve yetki karga\u015fas\u0131n\u0131n fark\u0131na var\u0131lm\u0131\u015f ve bunun sona erdirilmesi bir\u00e7ok rapor ve toplant\u0131da dile getirilmi\u015ftir. (1, 2, 3, 5, 6, 7, 8, 9) Ancak kurumlar bir s\u00fcre sonra yetkilerini ve sahip olduklar\u0131 g\u00fc\u00e7leri ba\u015fka kurumlarla payla\u015fmakta isteksiz davranmaya ba\u015flam\u0131\u015flard\u0131r. Kurulacak Afet Y\u00f6netimi Sistemi, koordinasyon ve yetki karma\u015fas\u0131na son veren, risk azaltma \u00e7al\u0131\u015fmalar\u0131na a\u011f\u0131rl\u0131k verdiren ve y\u00f6nlendiren, kaynak yaratmada katk\u0131 sa\u011flayan, izleyen ve denetleyen, afet olay\u0131na h\u0131zl\u0131 ve do\u011fru bir bi\u00e7imde m\u00fcdahaleyi sa\u011flayacak donan\u0131m, y\u00f6netim \u015femas\u0131 ve insan kaynaklar\u0131n\u0131 harekete ge\u00e7iren bir yap\u0131da olmal\u0131 ve en \u00f6nemlisi sistem profesyonelce i\u015flemelidir.\u00a0 Afet Y\u00f6netim Sisteminin, bilgi taban\u0131 ve ileti\u015fim a\u011f\u0131n\u0131 i\u00e7eren ve acil m\u00fcdahalede h\u0131zl\u0131 \u00e7al\u0131\u015fan bir \u201cAfet Bilgi Sistemi\u201d en k\u0131sa zamanda kurulmal\u0131d\u0131r. Ulusal sismik a\u011f sistemi, afet bilgi bankas\u0131 ve mikrob\u00f6lgeleme haritalar\u0131 bu sistemin vazge\u00e7ilmez unsurlar\u0131 olmal\u0131d\u0131r.<br \/>\nDeprem \u015euras\u0131 s\u0131ras\u0131nda yap\u0131lan tart\u0131\u015fmalar sonras\u0131 T\u00fcrkiye\u2019de afet ve acil durum ile ilgili konularda koordinasyonu sa\u011flayacak ve kurumlar\u0131 y\u00f6nlendirecek bir ba\u015fkanl\u0131k olu\u015fturmak i\u00e7in bir kanun tasla\u011f\u0131 yaz\u0131ld\u0131, ilgi kurumlardan g\u00f6r\u00fc\u015f al\u0131nd\u0131 ve bu taslak 29\/5\/2009 tarihinde 5902 say\u0131l\u0131 kanunla y\u00fcr\u00fcrl\u00fc\u011fe konuldu. Kanunda \u201czarar azaltma\u201d teriminin yer ald\u0131\u011f\u0131 belirtilerek bunun \u201crisk azaltma\u201d \u015feklinde de\u011fi\u015ftirilmesi \u00f6nerilmi\u015ftir (4). Kurulan ba\u015fkanl\u0131\u011f\u0131n ad\u0131 \u201cAfet ve Acil Durum Y\u00f6netimi Ba\u015fkanl\u0131\u011f\u0131 (10)\u201d olup do\u011frudan Ba\u015fbakanl\u0131\u011fa ba\u011fl\u0131d\u0131r. \u0130lgi kanunun ama\u00e7 ve kapsam\u0131\u00a0 (Madde 1) \u015f\u00f6yle tan\u0131mlanm\u0131\u015ft\u0131r (10):<br \/>\n\u201c(1) Bu Kanunun amac\u0131, afet ve acil durumlar ile sivil savunmaya ili\u015fkin hizmetleri y\u00fcr\u00fctmek \u00fczere, Ba\u015fbakanl\u0131\u011fa ba\u011fl\u0131 Afet ve Acil Durum Y\u00f6netimi Ba\u015fkanl\u0131\u011f\u0131n\u0131n kurulmas\u0131, te\u015fkilat\u0131 ile g\u00f6rev ve yetkilerini d\u00fczenlemektir. Ba\u015fbakan, Ba\u015fkanl\u0131kla ilgili yetkilerini bir bakan arac\u0131l\u0131\u011f\u0131 ile kullanabilir.<br \/>\n\u201c(2) Bu Kanun; afet ve acil durumlar ile sivil savunmaya ili\u015fkin hizmetlerin \u00fclke d\u00fczeyinde etkin bir \u015fekilde ger\u00e7ekle\u015ftirilmesi i\u00e7in gerekli \u00f6nlemlerin al\u0131nmas\u0131 ve olaylar\u0131n meydana gelmesinden \u00f6nce haz\u0131rl\u0131k ve zarar azaltma, olay s\u0131ras\u0131nda yap\u0131lacak m\u00fcdahale ve olay sonras\u0131nda ger\u00e7ekle\u015ftirilecek iyile\u015ftirme \u00e7al\u0131\u015fmalar\u0131n\u0131 y\u00fcr\u00fcten kurum ve kurulu\u015flar aras\u0131nda koordinasyonun sa\u011flanmas\u0131 ve bu konularda politikalar\u0131n \u00fcretilmesi ve uygulanmas\u0131 hususlar\u0131n\u0131 kapsar. TC Ba\u015fbakanl\u0131k Afet ve Acil Durum Y\u00f6netimi Ba\u015fkanl\u0131\u011f\u0131\u2019n\u0131n a\u00e7\u0131klamalar\u0131ndan bu kurumun T\u00fcrkiye\u2019de afeti y\u00f6neten bir kurum olmayaca\u011f\u0131, sadece ilgili kurumlar aras\u0131nda koordinasyonu, i\u015fbirli\u011fini, uyumu sa\u011flamaya \u00e7al\u0131\u015faca\u011f\u0131, yerelde afeti Valilikler kanal\u0131 ile m\u00fclki idare amirleri ile y\u00f6netece\u011fi, merkezde ise TC\u2019nin b\u00fct\u00fcn bakanl\u0131klar\u0131, h\u00fck\u00fcmetin ve devletin b\u00fct\u00fcn kurumlar\u0131, sivil toplum kurulu\u015flar\u0131 aras\u0131nda koordinasyonu ve i\u015fbirli\u011fini sa\u011flayarak afet y\u00f6netimini ger\u00e7ekle\u015ftirmeye \u00e7al\u0131\u015faca\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Kurum bu g\u00f6revi yerine getirirken \u00fcniversite ve sivil toplum \u00f6rg\u00fctleri dahil olmak \u00fczere ilgili kurum ve kurulu\u015flardan dan\u0131\u015fmanl\u0131k deste\u011fi almaktad\u0131r.\u201d<\/p>\n<p><strong>Do\u011fal Afet Sigortalar\u0131 Kurumu<br \/>\n<\/strong>Do\u011fal Afet Sigortalar\u0131 Kurumu (DASK) ve Yap\u0131 Denetim Yasas\u0131 gere\u011fi kurulan y\u00fczlerce Yap\u0131 Denetim \u015eirketi 1999 depremleri sonras\u0131 ba\u015flayan olumlu \u00e7abalar\u0131n \u00fcr\u00fcnleridir. Ancak, uygulamalarda beklenen rand\u0131man\u0131n sa\u011flanamad\u0131\u011f\u0131, yasalar\u0131n baz\u0131 zay\u0131fl\u0131klar\u0131n\u0131n oldu\u011fu konusunda tart\u0131\u015fmalar s\u00fcrmektedir. Prim \u00f6deyen \u00fcye say\u0131s\u0131 3,5 milyonu bulan DASK h\u00e2l\u00e2 kararname ile idare edilen bir kurum durumundad\u0131r; oysa ihtiya\u00e7lar do\u011frultusunda yeni bir d\u00fczenlemeyle kanunla\u015fmal\u0131d\u0131r. Sigorta sisteminin yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131 durumunda, giderek artan say\u0131da yap\u0131 sahibinin kat\u0131l\u0131m\u0131 ile b\u00fcy\u00fck \u00f6l\u00e7eklerde bir kayna\u011f\u0131n geli\u015fmesi sa\u011flanabilir. B\u00f6ylece, uzun vadede ruhsats\u0131z yap\u0131lar\u0131n da bu sisteme kat\u0131lmak \u00fczere tasfiyesi \u00f6zendirilebilir (2). DASK, yeterli bir prim farkl\u0131la\u015fmas\u0131 yaratmamakla sigortan\u0131n \u00f6nemli bir \u00fcst\u00fcnl\u00fc\u011f\u00fcnden yararlanmamakta, yurtta\u015flar\u0131 g\u00fcvenli yap\u0131larda ve kentsel \u00e7evrelerde oturmaya y\u00f6nlendirecek yeterli bir g\u00fc\u00e7 olu\u015fturamamaktad\u0131r. \u00d6te yandan, yak\u0131nda \u00e7ok b\u00fcy\u00fck \u00f6l\u00e7eklere eri\u015fmesi umulan sigorta kaynaklar\u0131, yaln\u0131zca deprem sonras\u0131 zararlar\u0131 tazmin etme \u00f6devini \u00fcstlenmi\u015ftir. Sigorta, bu durumu ile can kay\u0131plar\u0131n\u0131 ve bu kay\u0131plara yol a\u00e7an g\u00fcvenliksiz ve niteliksiz \u00e7evre ve yap\u0131la\u015fman\u0131n iyile\u015ftirilmesi gereklerini g\u00f6zard\u0131 etmektedir. Sigorta kaynaklar\u0131, bu edilgen tutumla, pasif bir birikim ve yaln\u0131zca tazminat paras\u0131n\u0131 g\u00fcvenceye alan bir sistem olu\u015fturmaktad\u0131r. Ayr\u0131ca, DASK y\u00f6netiminin yaln\u0131zca bir dizi finansal i\u015flemler ailesinden ibaret de\u011fil, \u00e7ok y\u00f6nl\u00fc sosyal ve ekonomik d\u00fczenlemeler yapmay\u0131 hedef edinen bir vizyona da y\u00f6nelmesi tavsiye edilmektedir. Baz\u0131 uygulamalara bakan vatanda\u015f DASK sigortas\u0131 ile devlet destekli konut yard\u0131m\u0131 tercihi aras\u0131nda bocalamaktad\u0131r. DASK\u2019\u0131n prim havuzunda biriken mebla\u011fdan deprem \u00f6ncesi zarar azaltmaya y\u00f6nelik iyile\u015ftirme ve g\u00fc\u00e7lendirme i\u015flerinde vatanda\u015fa te\u015fvik ve destek sa\u011flanabilece\u011fini g\u00f6stermesi, sigortaya kat\u0131lan vatanda\u015f say\u0131s\u0131n\u0131 art\u0131racakt\u0131r.<\/p>\n<p><strong>Yap\u0131 denetimi meselesi<br \/>\n<\/strong>595 say\u0131l\u0131 kararnameden, 2001 y\u0131l\u0131nda 4708 say\u0131l\u0131 yasaya d\u00f6n\u00fc\u015fen bir s\u00fcrecin \u00fcr\u00fcn\u00fc olan yap\u0131 denetim sistemi beklenen performans\u0131 g\u00f6sterememektedir. Bu yasa kamuya ait yap\u0131 ve tesislerle, askeri gizlilik ta\u015f\u0131yan yap\u0131lar ve k\u00f6y yerle\u015fik yerlerinde yap\u0131lan ruhsata tabi olmayan yap\u0131lar hari\u00e7, belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde ve d\u0131\u015f\u0131nda kalan yerlerde yap\u0131lacak yap\u0131lar\u0131n denetimini kapsamaktad\u0131r. Yeni yasada yap\u0131 denetim yap\u0131lmas\u0131 gereken il say\u0131s\u0131 27\u2019den 19\u2019a d\u00fc\u015f\u00fcr\u00fclm\u00fc\u015ft\u00fcr. Yap\u0131 denetim firmas\u0131n\u0131n, yap\u0131n\u0131n ta\u015f\u0131y\u0131c\u0131 sistemi \u00fczerindeki sorumlulu\u011fu 15 y\u0131l olarak belirlenmi\u015ftir. Tart\u0131\u015fmalar\u0131n \u201c\u00f6zel \u015firket mi yapar yoksa kamu mu yapar\u201d a\u00e7maz\u0131ndan \u00e7\u0131kar\u0131l\u0131p \u201cdo\u011fru, d\u00fcr\u00fcst ve nitelikli\u201d olarak yap\u0131lmas\u0131 \u00e7izgisine oturtulmas\u0131 gerekmektedir. \u2018M\u0131\u015f\u2019 gibi yap\u0131 denetimi bizi 1999 depremi \u00f6ncesi s\u00fcrd\u00fcr\u00fclen ve yozla\u015fan Teknik Uygulama Sorumlusu d\u00fczenine geri g\u00f6t\u00fcrmektedir.<\/p>\n<p><strong>T\u00fcrkiye\u2019nin deprem kar\u015f\u0131s\u0131ndaki zay\u0131fl\u0131klar\u0131n\u0131n nedenleri<br \/>\n<\/strong>\u00dclkemizdeki bir\u00e7ok kent ve yerle\u015fim yeri, arzulanan planl\u0131 duruma geri getirilemez bi\u00e7imde bozulmu\u015ftur. 1940\u2019larda ba\u015flayan ve tarihi konutlar ile ye\u015fil alanlar\u0131 t\u00fcketerek olu\u015fturulan yana\u015f\u0131k d\u00fczen apartman modas\u0131 \u015fimdi site-villa veya residans modas\u0131na do\u011fru kayd\u0131r\u0131l\u0131yor.
